The protection and security of personal data is an important concern of d&b. Therefore, d&b conducts its activities in accordance with the applicable laws for the protection of personal data and data security. This privacy policy informs you what information d&b collects, how d&b uses and safeguards it, and to whom d&b may share it.

With this information on data protection we would therefore like to inform you when we store which data and for what purpose we use it - naturally in compliance with the applicable data protection regulations.

Basic information

Unless otherwise stated in the following sections, no personal data is collected, processed or used when using our websites.

When you access our webpages, our web servers automatically collect general information. This includes the type of web browser, the operating system used, the domain name of the Internet service provider, the IP address of the computer used, the website from which you visit us, the pages you visit on our site and the date and duration of your visit.

This data cannot be used by us to identify the individual user. We only evaluate the information statistically and use it exclusively to improve the attractiveness, contents and functionalities of our websites.

Definition of personal data

The term personal data is defined in the German Federal Data Protection Act. According to this, these are individual details about personal or factual circumstances of a specific or identifiable natural person. This includes, for example, your real name, your address, your telephone number or your date of birth.

Legal basis for the collection of personal data

Insofar as we obtain your consent for the processing of personal data, Art. 6 para. 1 lit. a GDPR serves as the legal basis for the processing of your personal data.

When processing your personal data to fulfil a contract between you and d&b audiotechnik, Art. 6 Para. 1 lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.

Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR serves as the legal basis.

If processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for processing.

Data erasure and storage time

The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, data may be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

Collection and processing of personal data

Personal data is only collected if you provide it voluntarily, for example to carry out an order, a survey, a competition or a registration for personalised services. There you will be informed about the intended purpose of processing and, if necessary, asked for your consent to storage.

The personal data collected within the framework of our websites will only be used without your consent for order processing or processing your enquiries and, if necessary, passed on to the responsible company. Only with your consent will your data be used in a centrally managed customer and prospective customer database managed under the responsibility of d&b audiotechnik, and your data will be merged at d&b audiotechnik. The use of this data is restricted to purposes of advertising and market and opinion research. You can revoke your consent at any time with effect for the future.

Your data is encrypted before transmission and processing in order to protect it from access by unauthorised persons. Please note that unencrypted e-mails are not transmitted with access protection.

Application

You can apply online at d&b audio via our application portal (Persis). Your online application will be forwarded directly to the HR department via an encrypted connection and will of course be treated confidentially. We will of course use your details exclusively for processing your application and will not pass them on to third parties outside d&b audiotechnik.

Further information on data processing within the application procedure can be found in the privacy policy of our application portal. If you have applied for a specific position and it has already been filled or if we consider you suitable for another position, we would be happy to forward your application within the company. Please let us know if you do not agree to a forwarding. Your personal data will be deleted immediately after completion of the application process or after a maximum of 6 months, unless you have expressly given us your consent for a longer storage of your data.

Please note that we only offer the applicant portal for applications. Should you nevertheless apply to us by e-mail, we expressly point out that e-mail attachments are not encrypted.

If a recruitment activity takes place via a public career portal such as Xing or LinkedIn, we would like to point out that we have no influence on the data processing of the networks and that we can only view your data if you have made it publicly available in the network.

Download area requiring registration

If you download documents from us, you will receive them in return for the transfer of your personal data. We will use the data obtained from you in this way for the allocation of the download to your data and for announcements of workshops, campaigns and trade fairs within the scope of our legitimate interest.

Sales & Servies

Within the framework of our 'Sales & Servies' function, you can select your country via a country list. After selecting the appropriate country, all partners available in that country will appear. The data entered in the contact form via the 'Get in touch' button will then be sent directly to our partner in the respective country via e-mail in accordance with your selection.

Seminars and workshops

You can register for seminars or workshops on our website. Your registration data will be transferred to our CRM system. Pardot Marketing Automation System

Marketing Automation Cookies

We use these cookies from third parties to track your user behavior on our website. From the moment you leave personal data on the website (e.g. by using the contact form, or subscribing to the newsletter), your user behavior is merged with existing entries in our Salesforce CRM system and with newsletter tracking data. The profiling data is than stored in the CRM system and used in order to be able to send you targeted advertising and offers that meet your interests.

Newsletter dispatch and success measurement with Pardot

Pardot by the Pardot LLC (950 E. Paces Ferry Rd. Suite 3300 Atlanta, GA 30326, USA) is also used to dispatch and measure the success of our newsletter. The legal basis is article 6 (1) a) GDPR. We use the so-called "double opt-in" procedure to subscribe to our newsletter. This means that after you have entered your e-mail address, we will send you a confirmation e-mail to the e-mail address provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm this within 30 days, your registration will be deleted. If you confirm your wish to receive the newsletter, we will store your e-mail address until you unsubscribe from the newsletter. The storage serves the sole purpose of sending you the newsletter. Furthermore, we store your IP address and the time of registration and confirmation in order to prevent misuse of your personal data. Mandatory information for sending the newsletter are your Address, email address, surname and first name, company, city and country. The provision of further, separately marked information is voluntary and is only used to personalise the newsletter. This data will also be completely deleted upon revocation. We would like to point out that we evaluate your user behaviour when sending the newsletter. We use Pardot as an analysis tool for this purpose. The evaluation is carried out via so-called "web-beacons" in the newsletter e-mails sent. Web-beacons are small graphics in the e-mail, which enable a log file recording and log file analysis when opening the e-mail. For the analysis Pardot links the data for the registration of the e-mail newsletter and the information from the "web-beacons" with your e-mail address and an individual ID. The evaluations serve the purpose to recognize the reading habits of our users and to send content according to their interests. Data transmission to other d&b companies

We will not transfer your data to third parties outside the d&b Group, unless we are legally obliged to do so, or the transfer of data is necessary for the performance of the contractual relationship, or you have given your express prior consent to the transfer of your data. External service providers and partner companies only receive your data if this is necessary to process their request. In these cases, however, the scope of the transmitted data is limited to the required minimum. As far as our service providers come into contact with your personal data, we ensure that they comply with the regulations of the data protection laws in the same way. Please also note the respective data protection information of the providers. The respective service provider is responsible for the contents of external services, whereby we check the services within the scope of reasonability for compliance with legal requirements.

Data transmission to external service providers (processors)

Your data will be passed on to service partners if they work on our behalf and support d&b audiotechnik in the provision of their services.

Processing of your personal data by contracted service providers takes place within the scope of order processing in accordance with Art. 28 GDPR.

The aforementioned service providers only have access to such personal information as is necessary for the performance of their respective activities. These service providers are prohibited from disclosing your personal information or using it for other purposes, in particular for their own advertising purposes.

Where external service providers come into contact with your personal data, we have taken legal, technical and organisational measures and carried out regular checks to ensure that they also comply with the applicable data protection regulations.

Your personal data will not be passed on commercially to other companies.

Repair Order

If you place a maintenance order via our Repair Order function, the request is received centrally by us. All data that we request within the framework of the Repair Order is absolutely necessary for processing the order. Your personal data will be forwarded via our CRM system to the responsible d&b company or d&b service partner. This forwarding is necessary so that the responsible company or service partner can carry out the processing for you.

Google Ads

In order to draw attention to our services, we place Google Ads ads and use Google Conversion Tracking and the Google Tag Manager for the purpose of personalised, interest- and location-based online advertising. Eye-Able®

Eye-Able® is a software of Web Inclusion GmbH to ensure barrier-reduced access to information on the Internet for all people. The necessary files such as JavaScript, stylesheets and images are loaded from an external server. Eye-Able uses the local storage of the browser to save the settings when functions are activated. All settings are only stored locally and are not transferred further.

This is used for the purpose of fulfilling contracts with our customers (Art. 6 para. 1 lit. b DSGVO) and in the interest of a secure, fast and efficient provision of our online offer by a professional provider (Art. 6 para. 1 lit. f DSGVO). All transmitting data and servers remain in the EU at all times to enable data protection-compliant processing in accordance with DSGVO. Web Inclusion GmbH does not collect or analyze personal user behavior or other personal data at any time.

Social plugins

We use social plugins from various social networks (Facebook, LinkedIn, Xing, WhatsApp) on our website.

We offer you the possibility to log in via an existing social media account (Facebook, Twitter, Linkedin, Instagram, Xing, Youtube) through our website. In this case, you do not need a new user name and password to register.

You will be forwarded via the respective button (Login with Facebook, Login with Twitter) to the website of the social media provider and requested to authenticate yourself with your user name and password. If you are already logged in, this step is not necessary. You will then be informed of the data and authorizations we receive from the respective provider. Participation in the surveys is voluntary by clicking the URL provided. The information from your survey will be sent in encrypted form to the survey administrator and will be transferred automatically to our CRM system.

Webinars via Zoom

You can participate in our webinars via the videoconferencing tool provided by Zoom Video Communications Inc. (55 Almaden Blvd #600, San Jose, CA 95113, United States). As a first step, you will be invited to the webinar via the e-mail address you entered in your profile. To participate we will collect your name. Your name, e-mail address, IP address and device information, as well as your telephone number for dial-in via telephone, will be transmitted to Zoom for the creation and maintenance of the webinar. You do not need to activate your video camera or actively participate in the webinar. Messages exchanged in the chat are not stored, but are automatically deleted at the end of the videoconference. Please note that the webinars themselves are recorded and made available in the portal. We have also concluded EU standard contractual clauses with the provider in accordance with Article 46 (2) c) GDPR.  The legal basis for the collection, processing and use of your data for the purpose of conducting the webinar is Article 6 (1) b) GDPR.

Online shop orders

When you place an online order on our website, we collect the data required for concluding the contract. Data that is not required is marked as optional. The data is stored for the duration of the contract and in accordance with legal obligations. As far as necessary for the processing of the order, we forward your address data to a shipping service provider.  The legal basis is the conclusion and execution of a contract in accordance with Art. 6 (1) b) GDPR.

For payment processing, we use various payment service providers, which are always identified and accept your input. They are recipients of your personal data collected in connection with the payment process. The legal basis for the involvement of payment service providers is also the execution of the contract according to Art. 6 (1) b) GDPR.

Consult an expert

You can use the "Consult an expert" function to ask local d&b experts questions about our products. When you contact us, the data you provide (your e-mail address, name and telephone number) will be stored in order to answer your questions and process your requests. The legal basis in this respect is Art. 6 (1) f) GDPR. Insofar as we request input via our contact form that is not required for contacting you, we have always marked this as optional. This information serves us to specify your request and to improve the processing of your request. A communication of this information is expressly on a voluntary basis and with your consent, Art. 6 (1) a) GDPR. Insofar as this involves information on communication channels (for example, e-mail address, telephone number), you also consent to us contacting you via this communication channel, if necessary, in order to respond to your request. You can, of course, revoke this consent at any time for the future.

Your data that we have received in the course of contacting you will be deleted as soon as it is no longer required to achieve the purpose for which it was collected, your request has been fully processed and no further communication with you is necessary or desired by you.

Data security

d&b audiotechnik uses technical and organizational security measures to protect your data managed by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security measures are continuously improved in line with technological developments.

Rights of the data subjects

If your personal data are processed, you are affected within the meaning of the GDPR and you have the following rights against the controller:

  • Right to information according to article 15 GDPR
    You can ask us to confirm whether personal data concerning you will be processed by us. Once we have processed your data, you have further rights to information as set out in Article 15 of the GDPR.
  • Right to correction
    If the information we have collected from you is incorrect or incomplete, you may immediately request us to correct it in accordance with Article 16 of the GDPR.
  • Right to limitation of processing
    Under the conditions of Article 18 of the GDPR, you may also request that the processing of personal data concerning you be restricted. After the restriction, your data may only be processed with your consent or for the purpose of asserting, exercising or defending rights, or for the protection of the rights of another natural or legal person, or on grounds of an important public interest of the Union or a Member State. We will inform you before the restriction is lifted.
  • Right to erasure
    If one of the reasons in Article 17 para. 1 GDPR applies, you can request us to delete your personal data immediately, unless there is an exception to the deletion obligation in accordance with Article 17 para. 3 GDPR.
  • Right to information
    If you have exercised your right to correct, delete or restrict processing against us, we are obliged under Article 19 GDPR to inform all recipients of your personal data of this, unless the notification is impossible or involves disproportionate effort. They also have the right to be informed of the recipients. The person responsible shall have the right to be informed of such recipients.
  • Right to data portability
    In addition, according to Article 20 GDPR, you have the right to receive personal data concerning you from us in machine-readable format and to transmit the data to another person responsible without obstruction, provided that the requirements of Article 20 para. 1 lit. a GDPR are met, or to obtain that your personal data are transmitted directly by us to another person responsible, provided that this is technically feasible and no freedoms and rights of other persons are impaired thereby. This right shall not apply to the processing of personal data necessary for the performance of a task in the public interest or for the exercise of official authority.
  • Right of objection
    You have the right to object at any time to d&b audiotechnik GmbH & Co. KG processing your personal data in accordance with Art. 6 para. 1 lit. f GDPR. As soon as you have filed an objection, we will no longer process your personal data, unless there are legitimate reasons for the processing outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.
  • Right to revoke the data protection declaration of consent
    You have the right to revoke your data protection declaration of consent with declaration to d&b audiotechnik GmbH & Co. KG at any time. The revocation of consent shall not affect the legality of the processing carried out on the basis of the consent until revocation.
  • Right of appeal to the supervisory authority
    They shall at all times, without prejudice to any other administrative or judicial remedy, have the right of appeal to a supervisory authority, in particular in the Member State of your place of residence, of work or of the place of suspected infringement, if you consider that the processing of personal data concerning them is contrary to this Regulation.
